6. In-Home Sales and the FTC Cooling-Off Rule
BluePeak conducts in-home sales consultations. Under the Federal Trade Commission’s Cooling-Off Rule (16 C.F.R. Part 429), you have the right to cancel a purchase made at your home within three (3) business days of the sale date for a full refund. At the time of any in-home sale, BluePeak will provide you with a written notice of this right as required by law.
7. Appointment Requests and Contact Forms
By submitting a request for a free water test, consultation, or any other inquiry through the Site or any linked form, you consent to being contacted by BluePeak via phone, email, or text message at the contact information you provide. You may opt out of communications at any time by contacting us directly.
Submitting a form does not create a binding contract or guarantee service availability in your area.

BLUEPEAK DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLUE PEAK HOME SOLUTIONS GROUP LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCTS OR SERVICES OBTAINED THROUGH THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO BLUEPEAK IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify, defend, and hold harmless Blue Peak Home Solutions Group LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any rights of another.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Wake County, North Carolina. You consent to the personal jurisdiction of such courts.
